These Terms and Conditions (“Terms”, “Terms and Conditions”, “terms”) govern your relationship with https://www.sweetandspicy.com.au website (the “website” or “Service”) operated by Abundant Prosperity trading as Sweet and Spicy Entertainment ABN 653 439 762 13, (“Us”, “We”, “Company”, “SSS” or “Our”).

Please read these Terms and Conditions carefully before using the Service.

Your access to and use of the Service is conditioned on your acceptance of and compliance with these Terms. These Terms apply to all visitors, users, purchasers of our items, sellers of items on our website and others who access or use the Service.

The following terminology applies to these Terms and Conditions, Privacy Statement and Disclaimer Notice and any or all Agreements: “Client”, “You” and “Your” refers to you, the person accessing this website and accepting the Company’s terms and conditions. “The Company”, “Ourselves”, “We”, “Our”, “Us” and “SSE”, refers to our Company. “Party”, “Parties”, “Us”, refers to both the Client and ourselves, or either the Client or ourselves. All Terms refer to the offer, acceptance and consideration of payment necessary to undertake the process of our assistance to the Client (You) in the most appropriate manner, or any other means, for the express purpose of meeting the Client’s needs in respect of provision of the Company’s stated services/products, in accordance with and subject to the laws of Queensland, Australia. Any use of the above terminology or other words in the singular, plural, capitalization and/or, he/she or they, are taken as interchangeable and therefore as referring to same.

There are some defined terms in this agreement. A defined term is when a term is capitalised and unless context is otherwise required, the meaning of those terms will be explained in this clause (contract);

(a) Agreement – The terms and conditions which govern provisions of services offered by Sweet and Spicy Strippers.

(b) Business Day – A day Sweet and Spicy Strippers are open and trading for business.

(d) GST – Goods and Services Tax levied consistent to the A New Tax System (Goods and Services Tax) Act 1999 (Cth) (GST Act)

(e) Government Agency – Any State or Federal Governmental judicial or administrative body that has authority relating to the operation of this contract or the Customer’s role;

(f) Law- Any laws, official directive, class orders, or statutes by a Government agency, binding industry codes of practice applying to the condition of the services or the customer’s tole.

(g) Loss – Any loss (as well as profit loss and expected profit loss), action, claim, liability, cost, damage, charge, expense, outgoing, payment which a party suffers, incurs, or is at liability for – including interest, tax and legal costs.

(h) Services – The introduction and booking of topless models who will perform certain duties at the customer’s event or function. Duties could include; games hosting, poker dealers, waitressing.

Acceptance of this Agreement

(a) You do not have to sign this Agreement physically to agree to its terms. If you:

(ai) Ticked the “I have read and accept the terms of service” box when ordering the services online:

(aii) Give us instructions in terms of us supplying you with the services described below: or

(aiii) Pay the emailed invoice which include the terms and conditions or a booking deposit over the phone or via bank transfer to our account.

In doing this, you will be deemed to accept and read terms and conditions of the services.

(b) As part of the booking process, you must provide us with the details we reasonably request. In failing or refusing to provide details or if you provide the incorrect details, we have the right to refuse services or cancel the services.d a room to change in when she/he gets there.

Jurisdiction

Each user, be it either a buyer or seller is responsible for checking and verifying if there are potential legal limitations in the jurisdiction from which he or she comes to use our services and purchase our products. In any case, the company acts under the laws of Australia and this website and any all matters arsing as a result of its use will be governed where applicable by the laws of Queensland and where Queensland law does not apply or thee is a conflict, the laws of the Commonwealth of Australia.

Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect. These Terms constitute the entire agreement between us regarding our Service and supersede and replace any prior agreements we might have between us and you regarding the website or Service.

Purchasers

If you wish to purchase any product or service made available through the website or via invoice Service (“Purchase”), you may be asked to supply certain information relevant to your Purchase including, without limitation, your credit card number, the expiration date of your credit card and your billing address.

You represent and warrant that: (i) you are above the age of 18 (ii) you have the legal right to use any credit card(s) or other payment method(s) in connection with any Purchase; and that (iii) the information you supply to us is true, correct and complete.

By submitting such information, you grant us the right to provide the information to third parties for purposes of facilitating the completion of Purchases.

The services and Customer’s obligations

(a) This agreement applies to every instance to Customer orders services from Sweet and Spicy Strippers.

(b) Booked models attending the customer’s function agreed to perform their duties such as waitress, game host, topless, poker dealer etc.

The customer must ensure:
Every one who attends the customer’s function is over the age of 18 years-old. If the entertainers believe a guest looks under age, the guest must provide ID to prove they are over 18. If ID cannot be provided, the guest will not be able to attend the function while entertainers are present.
Customer has the correct authorisation and permits required by a Government agency and the law
Their access and premises of the function are well guarded and safe
Models are treated with respect and protected from harm
Every attendee of the customer’s function is aware of “No Touching Policy”

If these obligations are not followed, entertainers have the right to leave and no refund will be given.

No Touching Policy:

(1) Attendees of the Customer’s function are not permitted to touch models – except an incidental touch which is necessary for models to perform their duties and if the model instigates and gives consent for you to touch them.

(2) Models must not be intimidated, pressured or harassed in any way

(3) All models must be respected at all times.

Disrespecting performers by insulting or yelling profanities, throwing objects at them will not be tolerated and the model has the right to leave the job before carrying out the services without giving a refund.

Entertainers Safety and Privacy

(a) If entertainer and performer is placed into an environment considered by anyone of reasonable stature to be mentally, physically or sexually intimidating or threatening by any group, guest or person association with the booking, the performance will be immediately cancelled – without a refund.

Sweet and Spicy Entertainment is a strictly non- escorting business.

Photo Policy

Models generally don’t allow photos to be taken while working – waitressing/ Waitering or performing a strip show. If a person is caught taking photos without permission – the model may cancel the remainder of their shift or performance. There will be no refunds in this instance. Always ask for permission first… each model is different and some may permit photos at certain time if you ask them.

The show or service will be cancelled if:

A performer/ entertainer is unwillingly touched, fondled or groped during their show or service. If the model uses audience participation in their show – people are only allowed to touch the performer as directed by them.

If the above rules are not adhered too, the show or service will not only be cancelled but no refund will be given. Please inform your guests the seriousness of these rules – further – action may be taken with the law if these rules are breached.

General policies:

(a) There is a strictly no sex or full service or erotica policy.

(b) The customer agrees and acknowledges:

(i) Models must be paid before the start of the function and prior to the models beginning their duties at the event.

(ii) At the time of the function, the customer must provide a safe and spare bathroom or room for the entertainers to change in, before and after their performance.

(iii) The customer engages the model directly to perform the duties, agreed and any monies or other obligation but we exchanged between the customer and the model on the night of the function, including, any invoice given to the customer by the model for any payment of services.

(iv) Sweet and Spicy Entertainment is an intermediary agency connecting the model with the client.

(v) The client shall be entirely responsible and liable for the security and safety of the models for the duration of the booked event.

Payment and taxes

(a) Customer must pay Sweet and Spicy Entertainment the booking fee to secure the booking. Sweet and Spicy Entertainment must offer the customer a tax invoice in compliance with A New Tax System (Goods and Services Tax) Act 1999 (Cth) (GST Act).

(b) As well as the booking fee, the customer is required to pay the outstanding balance for the model’s services – directly to the model on the night of the event.

Refund and cancellation Policy

(a) Once the customer has paid the deposit, it then becomes a contract between Sweet and Spicy Entertainment and the customer and between us and our entertainers, that the function will proceed on the selected dates. As soon as the deposit is paid, your event will be locked in and we will not book the chosen entertainer for other events for the same dates to make sure your date and entertainers are secured.

(b) If a customer has paid a deposit for a service and the service cannot be provided due to a Covid19 lockdown in the region of the event, the customer will have the option to reschedule the booking to a later date, receive a credit for a future booking for the monies paid, or receive a refund of the deposit minus a $50 admin fee.

(d) Any requests for changes to a booking may be made 72 hours ahead of the booking – Sweet and Spicy Entertainment will do its best to accommodate all clients’ requests – but cannot guarantee the approval of those requests.

(e) If our entertainers are made to feel insecure at any time, mimicked, mocked or made to feel threatened – the entertainer can leave at any time – WITHOUT A REFUND.

(f) If the model does not show up to the booking, the clients deposit will be fully refunded.

(g) If the chosen model cancels the booking prior to the event we will inform you that they can no longer attend and give you the option to book in a different entertainer in their place.

(h) You understand and accept that SSE reserves the right to refuse or cancel your order at any time at its absolute discretion for certain reasons including but not limited to: product or service availability, errors in the description or price of the product or service, error in my order or other reasons.

(i) You accept that SSE reserves the right to refuse or cancel your order if fraud or an unauthorised or illegal transaction is suspected.

Representations and Warranties

(a) The customer represents, covenants and warrants to Sweet and Spicy Entertainment:

(i) The customer as all power, right and authority to perform the function.

(ii) The customer will have, if necessary, at all times security and appropriate guarding of the function.

(iii) The customer must comply with all Laws which apply to the function.

(b) The customer agrees and acknowledges:

(i) Sweet and Spicy Entertainment will do its best to try to meet the customer’s request for entertainers but accepts no responsibility or liability and has no control over if the available model on the night was different to the entertainer selected by the customer.

(ii) If Sweet and Spicy Entertainment cannot secure the model ordered by the customer it will do its best to advise the customer of this.

Limitation of Liability

(a) Sweet and Spicy Entertainment have no liability and the clients explicitly released Sweet and Spicy Entertainment from any liability and indemnifies Sweet and Spicy Entertainment against:

(I) Losses suffered by the client as a consequence of the customers use of the services.

(ii) Losses suffered by the client as a consequence of the client running the event.

(b) If liability is imposed on Sweet and Spicy Entertainment for any reason under this agreement, the total liability of Sweet and Spicy Strippers to the client for any reason on any cause of action and any loss shall be limited at Sweet and Spicy Entertainment’s discretion, to:

(i) re-supply of the services to the client, or:

(ii) the refund of the clients paid fees to Sweet and Spicy Entertainment’s in relation to the services.

8.Confidentiality and Privacy

(a) The client agrees and acknowledges the sensitivity and privacy of any confidential information must be guarded at all times.
(b) The client ensures the rules made out in this agreement in relations to conduct which concerns the model are known to all attendees of the function.
(c) The client ensures the model is not asked or pressured to give out her telephone number, email or any Identification details – if the customer becomes aware if any of their details – they must protect the privacy and confidentiality of this sensitive information.
(d) The client must not make contact or attempt to make contact with an entertainer after the function unless there is consent from the model.
(e) No photographs or videos can be taken of the model unless they consent to it.

General

(a) This contract/agreement records the entire agreement between the parties and superseded all previous understandings, negotiations or agreements.

(b) Any communication between the parties will be given to the other party in the same way the parties’ communicated to book the initial services.

(c) If any condition of this agreement is found to be void, illegal, voidable or otherwise unenforceable, the parties will amend the condition in a way that reasonably achieves the parties’ intention and the remaining conditions of the agreement will remain in full-force and effect.

(d) This agreement is governed by Queensland law. The parties submit to the non-exclusive jurisdiction of Queensland courts and any courts which may hear appeals from those courts in respect of any legal proceeding in connection with this contract.
